Shabana Mahmood has announced the final structure for migrants seeking permanent residency in the United Kingdom. The new framework establishes waiting periods that range from three to thirty years based on an individual's income, occupation, and entry method.

The policy replaces the previous standard timeline with a tiered system. Migrants earning over £125,141 and paying additional tax rates, along with those on Global Talent or Innovator Founder routes, will qualify for settlement in three years. Those earning over £50,271, skilled public sector workers such as doctors and nurses, and refugees arriving through government legal channels will wait five years.

The new standard for most other migrants earning below those income thresholds is ten years. This group also includes refugees who entered on a visa and later applied for status, provided they are currently working or studying. Individuals claiming specific benefits, committing visa offenses, or refugees who arrived by small boat and are now employed will face a twenty-year wait.

The longest timeline applies to refugees who arrived by small boat and are not currently working or studying. They will wait thirty years before gaining the right to live permanently in the country.

Mahmood adjusted her initial proposals following a wide consultation. She stated the system aims to be fair to newcomers who contribute and to British citizens who should not bear a greater burden. A key change involves care visa holders who arrived between the pandemic and May of last year.

These workers can now settle after five years if they met visa conditions and earned at least £25,000 annually. Approximately a quarter of this group, who were sponsored by companies for jobs that did not exist, will receive a new five-year visa. They must secure a job offer within 120 days or leave the UK.

The rules take effect immediately for those applying under the new framework. The government will monitor compliance with the income and employment requirements during the waiting periods.
